TERMS OF SERVICE

These Terms of Service apply to purchases made through lapisk.dk and to your use of our online store.
Nothing in these Terms limits or excludes any mandatory rights available to consumers under applicable law.

2. PRODUCTS
LAPISK sells products made primarily from natural stone, including washbasins, vases, candle holders, tealights, trays, bowls, tables and decorative objects.
Natural stone is a natural material and may vary in colour, veining, texture, pattern, tone and surface characteristics.
Natural variations that are reasonably consistent with the relevant stone type, product description, specifications and any samples or representations provided are not considered defects.
This does not limit your statutory rights if a product is faulty, damaged, incorrect or materially different from what was agreed or advertised.
3. PRODUCT IMAGES AND VISUAL REPRESENTATIONS
We aim to present our products as accurately as reasonably possible.
Some images may be digitally enhanced, styled, rendered or AI-assisted for visual presentation purposes. Where this is materially relevant, we aim to identify such images clearly.
Illustrative, digitally enhanced or AI-assisted images are intended as visual guidance and do not override the written product description, dimensions, material specifications or other product information.
Because natural stone varies from piece to piece, the exact colour, veining, pattern and surface characteristics of the delivered product may differ from photographs or other visual representations.
If the exact appearance of a particular piece is important to you, you are welcome to contact us before purchase and request available photographs or video of the specific item. This does not affect your statutory consumer rights.
4. PRICES AND VAT
Prices are shown in the currency displayed in the online store.
For private consumers, displayed retail prices include VAT where required by applicable law, unless clearly stated otherwise.
Shipping charges and any other applicable charges will be shown before the order is completed.
We may change prices for future orders at any time.
Once a binding agreement has been entered into, the agreed price will not be changed except where permitted by law or expressly agreed with the customer.
5. ORDERS
When you place an order, you will receive electronic confirmation that the order has been received.
The formation and binding effect of the agreement are governed by the information presented during the checkout process and applicable Danish contract law.
LAPISK does not reserve a general right to cancel a binding consumer agreement merely because of ordinary pricing errors, stock issues or website errors.
Where an obvious error has occurred, or where performance becomes impossible or another legal basis for cancellation exists, the matter will be handled in accordance with applicable law.
If there is a problem with availability or fulfilment, we will contact you as soon as reasonably possible.
6. PAYMENT
Payment is made using the payment methods available at checkout.
For ordinary consumer purchases, payment will be authorised and captured in accordance with applicable Danish law and the rules applicable to the selected payment method.
As a general rule, payment for ordinary goods will not be finally charged before the goods are dispatched unless there is a lawful and reasonable basis for earlier payment and this has been clearly disclosed.
Separate payment terms, including deposits or advance payments, may apply to custom-made, personalised or B2B orders where lawfully agreed.
7. SHIPPING AND DELIVERY
Shipping methods, estimated delivery times and applicable delivery charges are described during checkout and/or in our Shipping Policy.
Delivery times are estimates unless a specific delivery date has been expressly agreed.
Due to the weight and fragile nature of natural-stone products, large or heavy products may require freight or other specialised delivery arrangements.
Where special delivery arrangements are required, we may contact you to coordinate delivery.
Risk in consumer purchases passes in accordance with applicable Danish law.
8. RIGHT OF WITHDRAWAL AND RETURNS
Private consumers purchasing online generally have a statutory 14-day right of withdrawal, subject to applicable exceptions.

9. CUSTOM-MADE AND PERSONALISED PRODUCTS
The statutory right of withdrawal does not apply to goods made according to the customer's individual specifications or goods that are clearly personalised.
This may include products manufactured to individual dimensions, specifications, finishes or other requirements specifically requested by the customer.
A product is not automatically excluded from the right of withdrawal merely because it is ordered, sourced or produced after the customer places an order.
The exclusion for custom-made or personalised products does not affect statutory rights relating to faulty or non-conforming goods.
10. FAULTY, DAMAGED OR INCORRECT PRODUCTS
Consumers have the statutory rights provided under Danish consumer law.
For consumer purchases governed by Danish law, the statutory complaint period generally applies for two years.
If a product is faulty, damaged, incorrect or otherwise does not conform to the agreement, please contact us at info@lapisk.com within a reasonable time after discovering the issue.
Photographs of the product, packaging and shipping label may help us handle a claim efficiently, but providing photographs does not remove or limit your statutory rights.
Where LAPISK is responsible for a defect or non-conformity, remedies and reasonable associated costs will be handled in accordance with applicable law.
11. PRODUCT HANDLING AND INSTALLATION
Natural-stone products can be heavy and fragile.
Customers should follow any handling, care or installation instructions provided with the product.
Certain products, including heavy washbasins, tables and other large stone items, may require suitable lifting equipment or professional handling or installation.
LAPISK is not responsible for damage caused by misuse, improper handling, incorrect installation or failure to follow applicable instructions, to the extent permitted by law.
This does not limit statutory rights relating to defects that existed at delivery or defects for which LAPISK is otherwise legally responsible.
12. NO ADDITIONAL COMMERCIAL WARRANTY
LAPISK does not provide any additional commercial warranty unless such a warranty is expressly stated in writing for a specific product.
This does not affect any mandatory statutory consumer rights.
13. LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
To the extent permitted by applicable law, LAPISK is not responsible for indirect or consequential losses that were not reasonably foreseeable at the time the agreement was entered into.
Nothing in this section limits a consumer's mandatory rights under applicable consumer law.
14. B2B PURCHASES
Where the customer purchases goods as part of a business or professional activity, consumer-specific rights, including the statutory consumer right of withdrawal, do not apply unless otherwise expressly agreed.
B2B orders may also be subject to separate commercial terms agreed between LAPISK and the business customer.
If separate B2B terms conflict with these Terms, the specifically agreed B2B terms will take priority for the relevant business order.
15. INTELLECTUAL PROPERTY
Content created or owned by LAPISK, including trademarks, logos, product names, original text, graphics and original photographs, may be protected by intellectual-property rights.
Third-party content and AI-assisted or generated content may be subject to separate rights or terms.
Nothing on this website grants permission to reproduce protected LAPISK content for commercial purposes without prior permission, except where permitted by law.
16. PRIVACY AND COOKIES
Personal data is processed in accordance with our Privacy Policy.
Cookies and similar technologies are handled in accordance with the privacy and cookie choices available on our website.
17. GOVERNING LAW
These Terms are governed by Danish law.
For consumers residing in another country, this choice of law does not deprive you of any mandatory consumer protection available under the law that applies to you.

19. CHANGES TO THESE TERMS
We may update these Terms from time to time for future use of the website and future orders.
Changes do not retroactively alter the terms of an already concluded agreement unless required by law or expressly agreed with the customer.
The current version will be published on our website.
